Case Summary
The defense showed that harsh in-game insults arose from anger rather than a sexual purpose and challenged whether an online profile identified a real person to other players.
1. Background
During an argument with a person first encountered in a StarCraft match, the client used extremely harsh insults aimed at the other player and the player's family. Some expressions had sexual content, and the client was reported for obscene communication and criminal insult. The risk was increased because the other player had posted personal information during the match and similar expressions were repeated afterward.
2. Defense Strategy
The defense contested both allegations from the beginning. An obscene-communication offense requires more than the use of sexual language; it requires a purpose of arousing or satisfying sexual desire. The full game context, relevant acquittal decisions, and examples of actual game-chat usage were submitted to show that the words expressed anger during a dispute and did not serve a sexual purpose.
For the insult allegation, the defense argued that entering personal information in a game did not by itself establish that other players could connect the account to a specific real-world person. Identifiability and public exposure were addressed separately.
Counsel actively participated in the police interview. When the investigator repeatedly asked the client to assign a meaning to each expression, counsel kept the answer tied to the overall context instead of creating new sexual explanations. When a question suggested that sexual words were automatically criminal, counsel clarified the statutory purpose requirement. The practical conventions of game chat and the limited real-world recognition of information posted online were also explained.
3. Result
After an initial written opinion, attendance at the police interview, and a supplemental opinion reflecting the interview, police issued no-referral decisions on both the obscene-communication and insult allegations. No settlement was required.
4. Significance
The case demonstrates why purpose, context, identifiability, and the audience must be analyzed separately. It also shows how real-time legal assistance during questioning can prevent an imprecise answer from being treated as an admission of an element that the prosecution must prove.
