Sexual Questions Disguised as a Waxing Appointment Inquiry: Case Referred to Prosecution

Case Summary

A waxing-shop owner received repeated sexual questions and continued contact after a clear refusal. The full message sequence and map evidence helped establish the sender's purpose.

1. Background

The client operated a waxing shop. A person approached as if asking for an appointment, then moved from private questions unrelated to treatment to persistent questions about sensitive physical reactions that might occur during a waxing session. The client clearly stated that the messages caused sexual humiliation and asked the person to stop unless there was a genuine booking inquiry. Messages and attempted calls continued.

2. Representation Strategy

Because waxing services involve the body, the sender could argue that the questions were part of an ordinary service inquiry. Counsel therefore organized the entire conversation chronologically, including the first contact, the shift to private subjects, repeated demands for answers, and the continued contact after refusal. Ordinary booking questions about pain, duration, or available times were distinguished from the sender's repeated focus on sensitive reactions.

Map-search materials also showed that the area identified by the sender was a substantial distance from the client's shop and that many closer waxing shops were available. Without disclosing either location, this supported the inference that the contact was aimed at sustaining a sexual conversation rather than making a real appointment. A supplemental complaint connected these facts to the legal requirement of a sexual purpose and the objective nature of the messages.

3. Result

Police found sufficient grounds for an obscene-communication charge and referred the matter to the prosecution. The sender also expressed an interest in settlement during the investigation.

4. Significance

A business that provides body-related services may still distinguish genuine service questions from sexualized contact. Here, the sequence of the conversation, repetition after a clear refusal, and neutral map evidence combined to show the purpose of the contact while protecting the client's identity and business location.
