Exit Ban · 출국정지

Exit Ban in Korea: Can a Foreigner Leave During a Criminal Case?

If you are under police investigation or on trial in Korea, the Ministry of Justice can stop you from leaving the country. For foreign nationals this is called a departure suspension (출국정지). Many people only find out at the airport. Here is how it works under the Immigration Control Act, and what you can do about it.

Short answer: being investigated does not automatically mean you cannot leave, but an exit ban can be imposed while an investigation or trial is open, and you may not be told in advance.

For Korean citizens the measure is called 출국금지 (Immigration Control Act, art. 4). For foreigners it is 출국정지 under art. 29, which applies the same grounds. The periods, notice rules and objection procedure below are taken from the Act and its Enforcement Decree as in force from October 2, 2026.

Attorney Doyun Lee, a Korean Bar Association-certified criminal law specialist, advises foreign nationals on exit bans directly in English, together with the criminal case that caused them.

When can a foreigner be banned from leaving Korea?

Under art. 29 of the Immigration Control Act, the Minister of Justice may suspend the departure of a foreigner who falls under any of the grounds in art. 4(1) or 4(2). The criminal-case grounds include: a person whose criminal trial is pending, a person who has not finished serving a prison sentence, and a person whose departure is considered inappropriate for the purpose of a criminal investigation.

Separately, in urgent situations a prosecutor or investigative agency can ask the immigration officer at departure inspection to stop a foreign suspect from leaving (emergency departure suspension, art. 29-2). This is the scenario in which people are stopped at the gate.

How long does an exit ban last?

For investigation purposes (art. 4(2) grounds), the Enforcement Decree (art. 36) sets the period for a foreigner at up to 1 month. It can be up to 3 months where the investigation is difficult because the person has fled or similar special reasons, or where the person's whereabouts are unknown and the case has been suspended. Where an arrest or detention warrant has been issued in such a suspended case, the period runs for the warrant's validity.

For art. 4(1) grounds, such as a pending criminal trial, the period for a foreigner is up to 3 months. In both cases the period can be extended while the ground continues to exist.

The ban must be lifted immediately once the ground for it no longer exists or it is no longer considered necessary (art. 4-3, applied through art. 29(2)). In practice, this is where a lawyer can make a difference: once the reason for keeping you in Korea has been addressed, a request to lift the ban can be made with the supporting record.

Will I be notified?

As a rule, written notice of the decision, the reason and the period is required. For criminal investigations, notice can be withheld if it is considered likely to seriously and clearly obstruct the investigation, but once the total period including extensions exceeds 3 months, the person must be notified.

This means you cannot assume that no letter means no ban. If you have an open case and a flight booked, have your lawyer confirm your status with the investigating agency before you go to the airport.

How to object to an exit ban

You can file an objection with the Minister of Justice within 10 days of receiving notice of the ban or of an extension, or of learning about it (art. 4-5). The Minister decides within 15 days of receipt, extendable once by up to 15 days.

An objection is decided on the record, so what matters is showing why the ban is no longer needed: for example, that you have already given your statement, that you will return for later proceedings, or that the investigation does not require your physical presence. Attorney Doyun Lee prepares the objection or lifting request together with the defense in the underlying case.

What not to do

Do not try to leave quietly before your scheduled police interview. If you leave and do not appear, the investigation can be suspended with you listed as a missing suspect and a warrant can be sought; that can surface years later when you try to re-enter Korea. If you have already left, see the guide for people planning to come back to Korea with an open criminal matter.

Do not book non-refundable flights while a case is open until your travel status has been confirmed.

Frequently Asked Questions

Can I leave Korea while a police investigation is ongoing?

Often yes, but not always. An exit ban (출국정지) can be imposed for investigation purposes, and notice can be withheld in some cases. Have a lawyer confirm your status with the investigating agency before you travel.

How long can a foreigner be banned from leaving Korea for an investigation?

Up to 1 month at a time under the Enforcement Decree, or up to 3 months if the person has fled or their whereabouts are unknown and the case is suspended, or the validity period of a warrant in such a suspended case. It can be extended while the ground continues.

I was stopped at Incheon Airport. What happens now?

You were most likely subject to a departure suspension, possibly an emergency one requested by an investigative agency. Do not argue at the counter. Contact a lawyer, who can identify the agency and case behind it and prepare a lifting request or objection.

How do I object to an exit ban in Korea?

File an objection with the Minister of Justice within 10 days of receiving notice or learning of the ban. A decision is made within 15 days, extendable once by 15 days.

Does an exit ban mean I will be arrested?

No. An exit ban only restricts departure; it is not an arrest. Arrest or detention is a separate measure with its own legal requirements.

Can the exit ban be lifted before it expires?

Yes. It must be lifted once the ground no longer exists or it is no longer considered necessary. Whether that applies to you depends on the stage of the case, which is why the request is prepared together with the criminal defense.

Already outside Korea and planning to return?

Don't search for a lawyer after you're arrested at the airport. Have your Korean criminal defense attorney in place before you fly.
