False Accusation

Falsely Accused in Korea

The instinct when a false accusation lands is to hit back immediately — report them for making it up, confront them, post the proof. In Korea that instinct is usually the most expensive move available, and it tends to create a second case rather than end the first.

Filing a false-accusation complaint is not simply the opposite of being accused. It requires showing that the report was knowingly false, which is a demanding thing to establish — and a counter-complaint filed too early, before the first case has developed, often reads as pressure on the complainant rather than as evidence of anything.

That does not mean doing nothing. It means the order matters: build and preserve the record first, deal with the case in front of you, and assess a counterclaim on the evidence rather than on the anger.

Attorney Doyun Lee, a Korean Bar Association-certified criminal law specialist, reviews the record directly in English with foreign nationals facing a false accusation in Korea.

What to do first

Preserve everything, including material that is not flattering to you. Full conversation threads rather than selected screenshots, call logs, location and payment records, and anything showing the relationship before and after the alleged incident. Deleting or resetting a device does not remove what the other side has, and in a Korean investigation deletion is a recorded fact that gets assessed.

Then write a timeline while it is fresh, and stop contacting the other person. Repeated contact to "sort it out" is read as pressure, and messages sent in that state are frequently the most damaging documents in the file.

Defending the case in front of you

Accusations without direct evidence are usually contested on consistency and context: whether each side's account matches the surrounding record, whether it has changed over time, and what the relationship looked like before and after. That is built from documents, not from denials.

At the interview, the risk for a wrongly accused person is over-explaining. Long, improvised answers create inconsistencies that later get read as evasion. What is needed is an account that is accurate, limited to what you actually know, and consistent with the record.

When a counterclaim makes sense

A false-accusation claim is assessed later and on evidence — typically once the first case has produced a record showing what the complainant knew when they reported. Raising it at the right moment, supported by that record, is a different proposition from raising it on day one out of frustration.

The same applies to defamation counter-complaints and civil claims. They may well be appropriate; the question is sequencing, and that should be a deliberate decision rather than a reaction.

Frequently Asked Questions

Can I report the person for making a false accusation?

A false-accusation complaint requires showing that the report was knowingly false, which is demanding. Filed too early it usually reads as pressure on the complainant rather than as proof, so it is normally assessed once the first case has produced a record — not on day one.

Should I contact the accuser to clear it up?

No. Repeated contact is read as pressure and can create a separate allegation, and messages written in that state often become the most damaging documents in the case. Preserve the record instead and let it be handled through the process.

There is no evidence either way. How is it decided?

On consistency and context — whether each account matches the surrounding records, whether it has shifted over time, and what the relationship looked like before and after. That is why the full thread matters more than the one screenshot each side prefers.

Should I delete the messages that look bad for me?

No. The other side usually has them, and deletion becomes a fact in the investigation that is assessed against you. Material that looks bad in isolation is often explainable in context; material that was deleted is much harder to explain.

Can I be defended in English, remotely?
